In law, the onus is on the Plaintiff/Prosecutor to prove his allegation. In other words, it is the duty of the Plaintiff to prove his case against a Defendant. And he must prove his case beyond reasonable doubt. Hence, the defendant can exercise his right to remain silent through to the end of the case.
